Acceptance of Terms

By contracting our services of cutting down trees, trimming trees, stump grinding, clearing land, or any other services you promise to be bound by these Terms and Conditions. We are free to change, alter or update these terms at any time without prior notice. Treeremovaservice will keep any amendments on our website, and the further using of our Services, this will be considered as the acceptance of the amended conditions.

Interpretation

  • Customer / You is any individual, property owner, tenant, company or organisation that uses our Services.
  • We / Us / Company is used to refer to the tree removal service provider and its authorised employees, contractors or subcontractors.
  • Services can be defined as tree removal, pruning, trimming, stump grinding, emergency tree, debris removal or any other such type of work as agreed upon.
  • Property / Premises is defined as the location of the performance of the Services.
  • Reasonable Efforts refers to professional efforts which are utilized under the prevailing site, safety and environmental conditions.

Scope of Services

The performance of services is to be performed according to the written quote, agreement or work order. Any extra work that is requested but not stipulated in the agreed work may lead to a repricing and has to be accepted before it is implemented.

Services do not involve the restoration of landscaping, the replacement of turf, soil levelling, fence repairs or excavations of root systems of underlying soil unless specified.

Pricing and Estimates

All the prices are calculated on the basis of the information given at the moment when the quotation is given and the apparent state of the Property. The price can fluctuate based on the size, height, accessibility, ground conditions, risk of accidents, and equipment necessary as well as the disposal.

In case of real conditions of the site not being what was described or even inspected initially, then we will be able to charge appropriately. A Customer will be discussed with any changes and new ones and the work will proceed.

Quations come in as estimates and can be changed according to the need to do so.

Access to Property

The Customer should provide good and secure access of the Property to vehicles, tools, and machinery. Before the commencement, work areas have to be clear of personal belongings, vehicles, pets and obstacles.

We will not be liable in the damages of the things left in or around the designated work zone. The Customer shall be in charge of locating underground services, irrigation systems or hidden dangers that might not be apparent.

In the case of limited, slow, or unsafe access, we have the right to re-scheduling or suspending Services or charge accordingly.

Safety and Compliance

There is the inherent risk that is associated with the removal of trees. We are safety conscious and adhere to relevant health and safety procedures in work places. We can delay or abandon the work, in the event that the conditions are considered unsafe, such as hostile weather, unsafe trees, dangerous buildings, danger of wild animals, or existing utility lines.

Unless otherwise agreed in writing the Customer shall procure such council approvals, permits or permissions as are necessary.

Cancelling and Rescheduling

If a customer wishes to cancel or reschedule a lesson, they may do so without a fee or with a discounted fee based on the timing. Cancellations and Rescheduling The customer can cancel or reschedule the lesson without paying a fee or with a discounted fee depending upon the timing.

In case a Customer needs to cancel or reschedule Services, he or she should give reasonable notice. Depending on the level of booking and preparation, administrative or call-out charges can be charged.

We will hold the right to either reschedule or cancel Services because of weather conditions, equipment or safety issues or other unplanned events beyond our control.

Payments

The quotation or invoice will contain payment terms. We might demand security deposit prior to commencement of Services.

The payment can be made at the completion or otherwise as stipulated in writing. Any default in paying within the time agreed might lead to extra administrative fees, interests, or collection.

Customer would be liable to any reasonable expenses incurred in the recovery of outstanding payments.

Liability and Limitations

Although we exercise reasonable care in the performance of our Services, the activities of tree removal and other work associated with it are risky. We are not liable for:

  • Structural weaknesses or defects that are in existence.
  • Unreported underground utility, or irrigation systems.
  • Minor impact of the ground as a result of using the necessary equipment.
  • Loss that is caused by unavoidable situations.

The Customer is supposed to inform us about any issues on workmanship within a reasonable period of time in order to investigate the issue. There should be a chance to review and solve any problem prior to involving the third parties.

We do not have to bear the indirect and consequential loss such as the loss of business income and property value and any other secondary loss.

Complaints

Any grievances should be sent by the letter, containing pertinent information and evidence where feasible. We will discuss issues and seek a good and sensible solution. Should a dispute be unable to be settled on the spot then this will be forwarded to the relevant consumer authority.
